BDA slaps hefty tax on 5k properties that escaped acquisition@SHIVARAM KARANTH LAYOUT

Bengaluru: Owners of over 5,000 buildings that escaped acquisition and demolition by BDA for the formation of Shivaram Karanth Layout after the Supreme Court issued them regularisation certificates may be wondering if their legal battle was worth the trouble. BDA has now slapped a betterment tax on 5,171 properties in 17 villages. The tax rates vary by village ranging from Rs 465 to Rs 12,367 per square metre. BDA appointed a nodal officer Wednesday to issue the notices to all the properties and collect the betterment tax from their owners. These rates were approved at a recent board meeting of BDA. Explaining how the betterment tax is fixed, BDA's finance member Lokesh said, "We have taken the guidance values fixed by the state govt in 2018 and 2024 and considered one-third of the difference as the betterment tax under Section 20 and 21 of the BDA Act 1976." The betterment tax is collected for providing civic amenities in the layout. "We will be issuing the notices to the site owners to pay the betterment tax. One who pays will get A-khata. As of now, the guidance value is low at these places. Once the road connectivity is provided, the layout will get developed and the value of each site will double in the future," said Lokesh. Another senior officer told TOI, "Though BDA has huge assets in the city, as of now it is facing liquidity issues. Now by collecting the betterment tax from the property owners of the regularised buildings, BDA is expected to get approximately Rs 1,200-1,400 crore." The betterment tax goes up by 50% for commercial properties and 10% for plots with roads on both sides. "If a person has a building with 3 floors on a 30x40 sqft site at Kempapura and after the setback, if the built up area is 3,000 sqft, he will be charged Rs 30 lakh as the betterment tax," the officer said. Property owners, though, have criticised the move. "Till now there is no water supply to us and no road connectivity. But BDA is expecting us to pay the betterment tax for the development of the layout. Out of 17 villages, 16 villages are under a gram panchayat's limits and one village is under BBMP jurisdiction. All the development works were carried out by these two local bodies. We do not understand how BDA has fixed the betterment tax," Manjunath N, a resident of Kempapura, said. Ramagondanahalli resident Ramesh said, "During the land acquisition, all landowners get uniform compensation. When it comes to collecting tax, it varies. I have a 5,200 sqft property in Ramagondanahalli, which is regularised. Now, as per the BDA rates, I will be asked to pay Rs 58 lakh in betterment tax. The gram panchayat provided us with roads, drainage and other basic amenities. Why should we now pay tax to BDA?" BDA chairman N Jayaram said, "Naturally it is a burden for anyone who is asked to pay the betterment tax. However, the value of the sites will double with the development of the area as we provide them with better road connectivity with all basic and civic amenities. We have given compensation as per the area and the same is followed with betterment charges."
